OT lawyer question

My wife’s sister is married and she and her husband are always fighting and have separated a few times in the past. He cheats on her all of the time and she always takes the POS back. She became sick prior to them marrying. Her illness was attributed to a faulty medical device used install in her. They married after her corrective surgeries. They have no prenuptial agreement or property agreement. She sued the the manufacturer of the device after they married and is about to settle for 3-5 million. Given the circumstances is he entitled to any of the settlement when the soon to be divorce happens? They live in Crowley, La if that makes a difference.

Unless a portion of the settlement is for things like lost wages (compensating for wages that were lost during the marriage), then the entire settlement is considered separate property of the wife.

Which points out the necessity of getting to the med-mal lawyer NOW to MAKE SURE the settlement language is "properly worded."

It doesn't matter if it occurred before or after they were married, her pain and suffering is her's alone and it is her separate property if they separate or stay together. However, if part of it can be designated as lost wages during the marriage, that part may be considered community.

This is completely inaccurate. Louisiana is a community property state. You know the rules. Lawsuit was filed after the marriage and is settled before the end of the marriage and it is considered community property. I’m sorry your sister-in-law married such a douche.

Doubt she will get millions due to a faulty medical device, unless it is a rarely used devices manufactured by a very large company.

Just curious, should she put it into a joint account before filing for divorce, can he get half of it? Something else to consider when she gets it.
