Just watched a 48hrs online, wrongful murder conviction (no sneaky LEO set up or lazy work) and woman spent 8 years of a life sentence while family went broke hiring PIs to unground enough evidence to set her free.

We all know it's the best system we have and nothing is perfect.

So flaming aside: How would you fix the court system in the U.S.?

The number one thing that would improve the criminal court system would be to decriminalize marijuana.

If you want an answer from OT attorneys, come back and post this around 9am when they're waking up.

Loser pays system.. they pay all costs from attny fees, tests needed all the way to ink pens used at the courthouse. This would stop dumb trials and insurance coverage would come down.

As far as the scenario you stated above. I feel all murder cases should be held as a panel of three judges. Jury should only decide punishment not wither a person is guilty. There's a big difference in today's time to when these laws were written. The biggest being education. No one can convince me that billy bob down the road understands the law better then educated lawyers/judges.

If the DA withholds evidence from the defense or lies during any proceeding or any other bullshite, I'd make the DA spend time in jail; equivalent to the time the perp would have spent in jail.

A substantial portion of the docket in every criminal courtroom in the country day in and day out is guys in trouble for weed. It's stupid, wasteful, and fosters disrespect for the entire system. We need to decriminalize marijuana if we are ever going to fix the criminal justice system in this country. And I say that as somebody who hates lazy, no self respect having pot heads more than most.

There are far more issues with this justice system and just decriminalize marijuana isn't going to fix it either.

Myth.

There were a total of two people in jail in Orleans for possession of marijuana last week, yet Criminal District Court is one of the most inefficient courts in the state, if not the country.

Make it illegal for individuals to contribute money to judicial races.

So who funds the campaigns?

Are we going to a "rich judges only" system?

Have civil cases over a certain money threshold tried in front of three judges.

Ok but how many were in there because they were stopped for suspicion of having weed and ended up acting stupid or having bench warrants?

The point is that if you decriminalize weed you also get rid of a lot of other pointless low level offenses as well.

To fix this specific problem...modify prosecutorial immunity from an absolute to a qualified privilege.

Insurance companies don't want this because they'd lose almost all of their cases.
