You can thank an inexperienced legal mediator from Lafayette for this settlement!

Does the metro council hold this much power? Can they vote for a monorail and just have it green lighted? An interstate loop with a new Mississippi River bridge?

And also Morvant for not ruling on the cap issue. He should have ruled and let the appellate courts take it up if need be.

The Chester?

Only way he lasts longer than that is the money going to lawyers to keep pushing the case back.

It’s crazy how a POS turned into a martyr and his family are millionaires now

I’m sure it’ll go back into the community at a rapid rate

This is not correct. The law provides for one, single $500,000 limit or “cap” for all wrongful death claims associated with the wrongful death of any one individual in suits against the state or political subdivision no matter the number of claimants or suits filed. If a jury awarded $10,000,000 dollars to the family for Sterling’s wrongful death, the family would only get $500,000 total to be divided up. Furthermore, the maximum amount a person can recover for personal injury in suits against the state or a political subdivision is $500,000. This is a separate limitation or “cap”. Ostensibly, Sterling himself had a pre death cause of action for pain and suffering which action is inherited by his heirs and they asserted it on his behalf. If a jury awarded Sterling $10,000,000 for his conscious pain and suffering, mental anguish, and pre death fear, the city parish would only have to pay the “cap” of $500k. So, $1,000,000 total is the most the city would have to pay in general damages for all suits and claimants. The problem arises with calculating special economic damages, loss of support for which there is no limitation of liability. However, with Sterling what is a reasonable number that the children could be awarded for loss of support? Given Sterling’s history, small income, the family relationship and the ages of the children relative to the time they will become adults no longer entitled to be awarded loss of support, I don’t see how you get to millions of dollars in economic loss/loss of support. This settlement is beyond bogus.

Not that a single dollar is deserved in this case, but the fact there is a cap on how much a family can sue the government if they WRONGFULLY KILL YOU is fricking criminal.

We also have a cap on medical malpractice in Louisiana. It’s $500,000 in pain and suffering.

So that spine surgeon can have that third martini the night before, scrub into your surgery pretty buzzzed at 5 am, frick you up royally, and hey, you’re now a paraplegic. Good luck with the $500k for your loss of quality of life.
