There's a difference between fighting to defend yourself or to get another person to stop harassing you and assault. That trucker definitely crossed the line. I guarantee he knew exactly when the guy went limp.

You might be able to say he "should have" stopped but, like I said. Any failure on the part of the person being attacked to act rationally is the fault of the ATTACKER.

i think his self defense actions were reasonable.
if some stranger repeatedly comes at me and starts a fight with me, i'm not stopping until he is knocked out or incapacitated.
the trucker doesn't know if this guy is going to get back up and come at him again, possibly with a weapon this time.
that trucker did nothing wrong.
it would be bad form to keep beating on somebody if it was mutually agreed upon combat. but that NY punk assaulted the trucker and he was just exercising his right to self defense.

I'm alwasy fascinated by this view as I take the complete counter to it. There are a lot of dead people in this world that would be alive if they believed as I do.
If you don't like the POTENTIAL consquences of an action YOU CHOOSE, then you should probably choose differently.
While I do think that if a person can, they SHOULD control their anger. I do not fault them for failure to do so when they didn't start the situation. I find that concept completely unreasonable.
Why should I be at fault for the end of an event that were it up to me, would never have started?

correct. the trucker certainly couldnt have raped or robbed him, etc.

But only to a certain point.
I remember the situation from a year or two ago where the two dudes tried to rob a store at gunpoint, and the owner started shooting and hit one of them. He chased the other one (didn't catch him) and came back to the store, kicked the gun away, went and got his other gun, loaded it, and then shot the dude on the ground in the face killing him. I don't remember what ended up happening with him, but I remember all the talk of him being charged with first degree murder and whatnot, since he came back and shot someone in the face who was already subdued and no longer a threat.
Sure, this is a little different because it was a fistfight, but you can't legally just sit there and wail on someone until your hands hurt if they are unconscious...doesn't matter who started it.
I don't completely disagree with you, but legally you can get yourself into a LOT of trouble with your line of thinking.
