If he's hourly, technically you're supposed to pay him for responding to your email after hours. Because he's doing work related matters

I work in Corporate America and its pretty standard to answer email after business hours. If you bitch about it, then you'll be replaced by someone who doesn't mind.

Sounds like your colleague is a winey bitch.

Nothing hidden in this deal. My stance is an email can be sent whenever and it is the receivers choice on when it's opened. A complaint that it was rude to send it outside of normal business hours says more about reaction to the content of the email than it does about a made up breach in email etiquette.

If he has his work email on his phone, don't be pissed if he gets work emails on his phone.

Edit: I will call and/or email people when they're off as well. If you don't want to answer, don't answer the phone/email. But, don't answer the phone/email and be mad that I'm contacting you. Now I've got you on the phone so you have to answer my questions.
