This is close to correct.

I actually have experience with this type of situation. I hit a cow and it totalled my car.

Here is what you do. You file it with your insurance and report the home owner. They have lawyers who pursue it. If they decide to and win you get your ded back.

However, I think you made a major mistake by not calling the cops and filing a report.

Thanks guys I appreciate the info. I will be checking with my insurance tomorrow.

I didn't call the cops for a police report but I do have a witness. Not sure if that will help any.

Your biggest mistake and why you won't get any damages.

You do not leave the scene of a vehicle incident without a police report. Period. They can't do shite for you now.

Yes, I was going right at the speed limit. Then I slowed down a bit when I saw the dog. It was actually walking away from the road. Then when the dog heard me get close it must have spooked it because he reversed direction and took off across the road to the owners house. I nailed my brakes barely clipping it.

I'm not going to bring it to court. If my insurance can't straighten it out or a letter drafted to the dog owner can't get his homeowners insurance to pay for it I'll take care of it myself.

Many ins companies have a damage threshold where no report is required ($500 - $1000). I know this firsthand from a deer head butting my fender.

Not having a police report would hurt in court, but if you wind up in court over a dog cracking your fender, then everyone involved sucks.

Btw, if the guy didn't care much about his dog, he ain't gonna care much about your bumper. So I repeat, don't make much over this, cause no one else will. Fix your car with your ins money and move on.

My 90# yellow lab escaped while I was getting some kayaks out of the back yard. He ran full speed into the side of a Mitsubishi 3000GT, thinking he was chasing a dog on the other side of the street. $2400 worth of damage to the car. Dog was only slightly stunned, bruised up for several days.

As to the OP, his Homeowner's Insurance would cover.

Sure thing.

Actually just got off the phone with them. Looks like I'd have to go ahead and file a claim to get any decent information out of them. I'm working on getting some repair quotes first.

Im gonna side with the OP. I would get my car fixed and Im not hurting for money. I swear the OT has some people that like to strut the line and jump on the side that benefits them best.

OP, you are not an ahole for trying to get your car fixed. Dog should have been on a leash.

When do we start taking responsibility. dog owner in this case. not the driver.
