Good.
You think the prosecution will bother retrying the first degree murder charge? I wouldn't. There's no statute of limitations on murder, so they can always retry it if he ever gets out somehow or other in the future.

They could, but the defense would argue it wasn't a speedy trial and it would probably be dropped.

if the 75 is hanfed down it would be a waste of money to retry.

The mistrial on the 1st degree came from both sides telling their parts. There was an uncertainty whether or not the kids incited Dunn by getting out of the vehicle or threatening him. I think its still b.s. but oh well

whole thing seems kind of logical
overcharged on the one he shot, was a spur of the moment thing, should have been second degree
then he shoots at fleeing car, obviously not threatened then, obviously guilty (view from outside looking in)
If everybody was the same race the outcome would be perfectly alright, except for the family of the dead kid.

Why wouldn't it be premeditation if he grabbed a gun and walked up to them with the intention of killing them? How pre does the meditation need to be?

Fits more into the heat of the moment type of homicide. First degree seems like a huge stretch (being kind) unless he was trying to rob the guy.
