A good question would be, if you were intoxicated and above the limit, and say some nut runs out in front of you and you hit them and call 911 etc., would you be charged for the injury along with the DUI or just a DUI?

If you were drunk, they'll charge you for it and you would have to prove yourself innocent. If you had a decent lawyer and some evidence, you may have shot at beating it but you're damn sure getting charged with it.

Um. She was an SU Alumni going out meet friends at a popular club. Parking lot was full so she had to park across Sherwood.

Branch got something like 7.5 years for vehicular homicide for killing a cyclist while DWI on Perkins Rd near the Penington building many years back. IMO, he got off rather easy, when there was a bar tab that had been furnished, showcasing a $90 bar tab over the span of an hour. The guy was really fricked up when he was arrested by BRPD.

From reading a couple of recent articles, she was walking with 2 other people across the road when she was struck.

She was actually on the phone with her cousin when she was hit and one of the people picked up her phone and told the cousin she was hit.

So at least he didn`t leave the scene of a person that had no help.

We all know, you shouldn`t be crossing a road when there is a car coming but we see people doing it anyway and sometimes you have to put on your brakes and swerve to avoid hitting them.

No matter who`s fault it was, it`s a shame this young lady died like that.

Pretty much any accident where someone is drunk they are at fault.

So yes if I jumped in front of you and you are drunk you would be at fault, or at least in the eyes of the officers arresting you. Especially if I was dead and couldn’t say I was trying to commit suicide or something.
