The bottom line is the board found him guilty based on evidence that wouldn't hold up in a court of law. They aren't expelling him for cheating or plagiarism, they're expelling him for sexual assault based on a flimsy case. Those accusations don't carry the same weight. What they're doing to this guy, and the girl to some extent, is borderline criminal.

Let me get this straight, she gives some guy head who was so drunk he was blacking out and couldn't remember what happened for however long. Then she kicks him out. Then she sends texts and trys to get other dude over. Dude arrives over there. Dude refuses to have sex with her for two hours. Seems to me we are talking a 3-4 hour window. Then she finally gets the dick she worked so hard for. Now after what, about 5 hours she is finally sober enough to decide the first dude raped her? And the "rape" caused her to literally beg for some dick for hours?

Let me help educate you:
1. If you are a guy and blackout drunk, the chances of you being able to achieve and maintain an erection are not very good at all.
2. If you are able to achieve and maintain an erection, the last thing that happens is blowing your load quick. That can take hours and probably isn't even going to happen at all if you are that drunk.
The VASTLY more likely scenario, is that she tried to suck the dude for a while and he couldn't even get or keep a hard on as he barely even knew where he was. She got frustrated, felt guilty, kicked him out, but still wanted dick. This is like 10,000x more likely considering her actions after and the fact she begged for 2 hours to get it from someone who didn't even want to give it to her in the first place.

Doesn't matter. She took advantage of him while he was in and altered state of mind. He was unable to give legal consent to her sexual advances.

He didn't deny it because he was blackout drunk and couldn't remember anything from that night. His story has always been consistent, which was noted by the investigator, et al. If he tried to deny it, he'd be painted a liar and his credibility hurt. In this situation, I don't remember because i was black out drunk is (should be) a valid explanation.
On top of that, Amherst's empowering victims policy/procedures stacked everything against Doe. She, as the accuser, no longer had the burden of showing she was raped. Rather, even though he was incapacitated, he (without counsel) must no unequivocally show it didn't happen for him to not be expelled. That doesn't even address the litany of other procedural issues with this situation. Why should her story stand now when it has been shown that she lied to investigator and panel and witheld evidence.

So you're more in the "guilty until proven innocent" camp then?
You do realize when someone is accused of a crime it's not up to them to deny anything, right? The burden of proof is on their accuser to prove they did it.

I don't know what crimes they handle, but if I found out that my child went to the school saying she was raped and they encouraged her to stay away from the police and have it handled internally, you can believe heads would roll.
