I get pulled over on I-10. Cop gives ticket. After giving my ticket, he then asks to search my car. I decline. He then says that I will be arrested for disobeying a lawful order if I don't comply. From what I understand, I waive my 4th amendment rights by saying yes.

I only know of 2 options...declining and probably having the cop respond by calling in a K-9 unit or allowing the search...is their another option?

quote:

According to you, I should consent, because the cop can kill me, arrest me, and give me a bad day if I don't.

I am not telling you what to do. I am telling you what I do to avoid the possibility of being jammed up or worse by a cop on a power trip. I was pulled over recently by a cop in Mississippi for a bullshite reason and let him do his thing and was on my way 3 minutes later.

quote:

That's no different than a criminal pointing a gun to my head and demanding I do something.

I have never said it was ok for a cop to abuse his power...merely stated I know it is a possibility he will and choose to make my decisions on how to deal with them knowing this is a possibility.

I for one don't believe cops are trying to be unlawful while performing their job.

I agree. They understand their job is to protect and serve the community. Their execution is where my issue lies. It's not that they're trying to be unlawful; it's that they do unlawful things because they feel that it allows them to protect and serve.

Or they don't even know the law.

Nope that's about it AFAIK. Personally, I would want to fight it out in court if the stop was totally bogus, so I would still say no. Make him get a warrant, and call the dogs out. That way if it goes to court, the warrant can be fought. If I give consent, I can't fight it. I would do that not because I have anything to hide, but because as you said, if the cop is abusing his power anyway, what's to keep him from planting something or worse. Whatever the results of that search would be (legitimate or not), as long as I don't give consent, it can be suppressed.

Ultimately I wouldn't comply there because I don't have enough trust for them to do a good job.

To me that sounds a lot like he's butthurt over all the bad press PD's have gotten recently, and he plans to defend them by whatever means necessary to quiet opposition. How is that not fascism?

Ok, so his solution to quiet the racebaiters and Al Sharpton is to
quote:

make every attempt to have you investigated, charged and prosecuted at the local, state or federal level.

I don't necessarily agree with his presence, but it's not illegal. What would this guy possibly have him charged and prosecuted for?

I don't care if he was George Wallace, he has a right to say whatever his fat mouth wants to. I don't agree with what he says, but he entitled to it.

Sounds like the police who, as a trained practice, lie to citizens about evidence.

And all over the country visible via social media who band together and lie on police reports

If only we held admissible legal documents, like police reports, to this same standard.

Does believing police are overmilitarized, and rarely held accountable, now equate to agreeing with Al Sharpton?

A key tenant of statists is finding the right crime to fit whoever they don't like. In the words of Stalin's former chief, "Show me the man, and I will show you the crime." I am sure if you look hard enough you can find something.
