I guess the thread was rhetorical because it very much is a law, and people turning left in this situation do get cited for being at fault. Just wanted to spark debate at the absurdity of it.

Driver A is at fault as long as its a legal place to pass and not within 100 feet of an intersection.

Left turns are not illegal.

However the law states a driver of a vehicle being overtaken must yield the right of way to the passing vehicle.

Driver a is in the wrong. Driver b has right of way. I learned this from brpd during accident

Driver b is in the wrong. I learned that during a drivers safety course I was forced to take in BR.

This. Driver B had possession of the lane and this has the right of way. It's certainly not cool, but it's the way I've had two cops from two different agencies in LA explain it to me.

Driver A due to the private driveway. If it was another roadway different story. All the whining and name calling won't change this fact.

Many years ago I was driver A in Baton Rouge. Had my signal on and went to turn. Driver B hit my rear driver quarter panel. B got the ticket.

So if driver B is coming up on driver A and driver A has his signal on and is slowing down to turn and starts to turn while driver B starts to pass then A is at fault.

What is he supposed to do stop dead in the road and let about pass before turning?

It changes the situation if one driver has already began his turn before the other started passing.

The turning vehicle would have lawful possession of the lane at that time.

One possibility I see is that they rapidly slowed and then turned with no blinkers.

Guy sees them slow and attempts to pass, mid pass the turn begins.
