Didn't everyone just say when you step off the public waterways, you are trespassing? So if he drove off of the public road he'd be trespassing.
That's not your water, and that's the basis of the argument. You want your own water? Fill in the entrance with mud and make it a pond

so that begs the question, again.
You're perfectly ok with someone motoring through your property, stopping in the middle of the dead in canal or pond and shooting ducks that fly overhead? As long as the duck lands in the water and not on the land, I can pick up the duck and you're ok with that?

same thing with alligators? If the state issues me 25 tags a year, am I allowed to go onto anyone's property to fill my tags? As long a my traps aren't touching the land?
What about crawfish traps, can I crawfish wherever I want?

Use of "navigable" or "running" waters has always meant only use that is incidental to navigation. Doesn't mean the public can do anything they want.

its simple. you either need the money from the lease or don't. when you lease out to an oil company, they come in and dig canals. now your land is eroding away much faster and your property line shrinks. IMO those canals if not damned off are now public waterway since they are tidal.
so in other words. don't lease it out for $$$ and you won't have people trespassing

So if you buy into a deer lease next to public land, I expect you to run all the deer off your property, cut down all the trees, fence it in, and raise your own deer and habitat.
