About 2 years ago I witnessed a fender bender, nothing big. Yesterday I come home to a summons/subpoena sitting on the door step of my house. It's a witness summons for a ticket the person got. First, can they just leave it on the door step without anyone home. What would have happened if it blew away and I never saw it. I got home from work late that night and it was just sitting there and I'm the only one there.

usually these have to be served by a sheriff
who is subpoenaing you? the state or the driver?
what court is this? is this for a trial or deposition?

this is why they're supposed to be served on a person. even "domiciliary" service is on a person, just a member of the residence (over 18) who is not the person of whom service is being requested

It says testify on behalf of the State. It looks like its for traffic court for the ticket the person recieved. Also the paper was just left at the door. It still has the sheriff's return section attached at the bottom. It looks like the sheriff's was supposed to fill out the info and turn it in or something, but it's all blank.

Sounds similar to the bullshite Leon was doing in New Orleans. Would you take a picture of it (edit out any identifying information) and post it?

here they leave cards asking you to call the civil sheriff
if this is how EBR does "service", that whole legal system is about to be in trouble

yeah. sometimes in civil cases cheap attorneys who don't want to pay for a subpoena will do this, too.

They probably have a copy that was used to complete this section.

They have to leave it with a person. This is silly.
Also, how serious of an accident was it that the state is subpoenaing witnesses lol? DUI?

probably a self-represented person who believes "if the cop doesn't show up, I win" forcing a trial

It was a legit fender bender. No DUIs were given and this happened almost 2 years ago.

Also, work wont give me paid time off for this. It's only for jury duty that we get paid for, so I would have to use vacation. What if I said I just never got it what would happen then?

you run the risk of having an LEO going to your home/work and arresting you and bringing you to court
i've seen judges order this before trials before

also just fyi, that paperwork probably has a secretary or trial assistant to call. call him/her and see what's really up
usually they'll tell you that they'll call you when/if you need to show up

Are you sure that this is a mandatory thing and not a request?
When I got smashed in between two vehicles in EBR they asked me to testify against the lady who started the wreck. She was being charged with reckless operation or something like that. She was an older lady who hit the gas instead of the break, not a drunk or anything like that.
Her insurance had already paid for my totaled truck so I politely told the prosecution that I would not be testifying as I didn't care if she was found guilty or not since my truck had already been paid for.
