When this matter is tried to a jury, a good litigator will take these photos and make CC feel like THEY are being raped with an Eiffel Tower. This was an arrogant, thoughtless and stupid effort to trivialize the assault, which is never a good strategy.
And I don't side with either group, 


There are some very smart people in the CC community, including attorneys. Apparently they're not in the loop on this or aren't being listened to

Either. If a parent knew it was going on and didn't do anything they are liable. I believe it would allow for discovery too.

No one will ever want their kids to go to cedar creek again unless something is done. Even if judge deems it frivolous it still shows that someone attempted.

If a parent or teacher ignored rape or sexual assault and didn’t alert the authorities they should absolutely be in deep trouble. The question right now is if that actually happened. As far as bullying I’m just not sure what the school knew. I feel very confident like most, the young man was bullied

Oh! I see now. You have to have been bullied before to understand how none of the other kids could see the evil in their schoolmate getting sodomized for weeks in front of half the class to report it to authorities.

If with you. Clearly the kid was being bullied and those kids should be dealt with accordingly. But something doesn’t add up with the whole sexual assault allegations. It seems exaggerated at the very least. If they were poking him in the butt with objects over the pants. Ya gotta be careful what you’re asking hear with the details. These are still just kids.

People keep saying this but the court documents say “anal penetration.” It isn’t remotely the same.

This Bearden guy seems to be primarily an investigator who went to law school to make himself more effective as a PI. I wonder what kind of litigator he is.

One of the board members is an attorney, and the board's response definitely seemed written by an attorney.

I'm shite at putting 2 and 3 together, but I'd guess an attorney is involved.

This could just be a big fish in a little pond type of response. It might work unless the dam separating the pond and the ocean is opened.

Nothing on the Tech board about this. It's not super busy but they do get some traffic. It's like they're pointedly ignoring it.

I've only read bits and pieces of this story and a few posts, but there was a major incident involving Ooltewah High School here in Tennessee a few years ago. Players raping younger teammates with a pool cue while at a rental house in Gatlinburg. No adults in the house at the time. Victim suffered severe internal injuries requring surgery. Allegations of a culture of bullying and hazing. Coaches and athletic director charged because they did not immediately report to authorities as required by state law.

I don't know how similar it is to this case or not. I'm just mentioning the story for reference. Google "Ooltweah Basketball Sexual Assault" and you'll fund tons of articles. Y'all can determine how relevant it is. In Tennessee the laws regarding reporting suspected abuse are really strict.


Authorities not notified until the hospital staff did.


Victim required surgery, adults charged
