Pretty sure illegal discharge of a firearm could itself be a felon in California, right? So the fact that the gun even discharged in his possession could be a felon that lead to a death and would open the door to the more serious charges posters here would like to see.

That's suggestion someone made a mistake. It that amount of zealotry isn't a mistake, then it's not "too zealous", it'd be an appropriate amount of zealotry.

It could be. Up to the prosecution:
Penalties for Negligently Discharging a Firearm. Penal Code 246.3 negligent discharge is what is known as a “wobbler” in California law—meaning that it may be charged as either a misdemeanor or a felony. The prosecutor decides whether to charge this offense as a misdemeanor or a felony.
The prosecution chose to prosecute him as "felon in possession of a firearm," but i did not see where he chose to prosecute on negligently discharging a firearm and because the prosecutor has to weigh in on this "wobble" law in California, it cant be assumed one way or the other.
