Well that much is painfully obvious
And whoever it was SHOULD HAVE educated themselves beforehand. That created a PR disaster for the airline and the contracted firm and could be a fireable offense given said PR nightmare

There is no doubt that this is is a heinous act by the flight attendant.
Would or should a 14 year old have known that the setup pictured above was an iPhone taped to a toilet lid? Probably. You can clearly see what appears to be an iPhone under the tape.
Accordingly, does that 14 year old have some responsibility to not just ignore the iPhone and use the bathroom anyway? Probably.
Would your answer change if it was a 9 year old?
Would or should a 9 year old have known that the setup pictured above was an iPhone taped to a toilet lid? Maybe. Probably?
At what age should a child know that the setup was an iPhone and not use that bathroom?
In any event, the issue of whether to raise that possible defense should have been discussed with AA by the attorney prior to filing the answer.

If I'm ever in a public bathroom with a lid (and sitting down) my typical routine is to pull my pants down and then lift the lid and sit down in a single motion. I, as a 30 y/o, wouldn't have given a second thought to it until after I was done. The 14 year old did exactly what I would've done: business first and then notice what's off.

Faced the other way? I mean, it's clear she spotted it immediately after, which is why we even know about it at all, but people have different habits when it comes to toilets. Some of us are trusting, face-forwarders and some are the kind to stand up and wipe like they're sandpapering a 2x4.
My point being, I can totally see how a 14 y/o, or anyone, wouldn't have noticed anything off until they're done

I'd say that a 14 year old knew or should have known that an iPhone was taped to the toilet lid, and she should not use that bathroom. I certainly would not blame her 100%, perhaps no more than 5%, but I think she can't just ignore the obvious iPhone.

I'm not sure where to draw the line between those two ages.
Remember, this is not criminal litigation. This is a lawsuit about money. I'm not even arguing that AA should have raised comparative fault in its Answer. I'm merely issue spotting.
