You cant make false claims of a hate crime. Its up to the DA to choose whats considered a hate crime.
If we are just talking false accusations all together, if the person making the claims is financially stable, I would rather start with some type of major financial penalty being awared to the victim. For the instances where this isnt the case, some type of minor jail time/community service woukd have to do.

Exactly why hate crime laws shouldn’t exist, crime is crime regardless of race, sexuality or whatever else those laws apply to in today’s world.
