All he had to do was pull on the door handle, that is, attempt to gain access to Gasser inside the vehicle. If Gasser testifies that at the time of the attack he felt the fearful of an imminent threat of death or great bodily harm, then it's justified homicide.

Didn't Gasser shoot McKnight from his own vehicle? If Gasser was out of his vehicle, then all he has to do is testify that he was fearful that McKnight through his actions was about to threaten his life or cause him great bodily harm and it's still justifiable homicide. There are two cases here for the use of deadly force in self defense.

I wonder if they have any reliable witnesses. That intersection is always busy. Gasser’s attorney better hope they have someone willing to say they saw McKnight pull on the door or jump into his window. The fact that his passenger window was even down shows he was likely talking shite when Joe got out. Plus his history of doing the same exact thing is going to be a pretty big key here. The defense better come to play.

We've gone through this. He will be eaten alive with his 2006 incident that happened at the same intersection. He followed a guy to a gas station and punched him several times. He will not be able to go with the fearful for his life defense as easily as you think.

He doesn't have to drive away and failure to do so cannot be held against him in Louisiana law.

Also it’s hard to say you are “fearful” when you don’t take the most basic steps to protect yourself. Check this guys Netflix cue and I’ll bet he was just watching Falling Down.
