Do we know that?
Well Gasser admitted to it, so maybe he is lying
quote:
“Mr. Gasser, in his statement, says he was irritated by that and set off after Mr. McKnight,” Normand said.

So, we have a man that phycically assaulted another human in a road rage incident, admitting to starting this altercation by "setting off for JM"
So, actually, it seems Joe was pretty damn reasonable to fear for his own life

I that why he boxed Gasser in, exited his vehicle and approached Gasser's vehicle?

Are you now seeing why they wont argue for "fear for his life"

JM was the car on the right of Gasser that boxed him in....if JM hadnt pulled up illegally on the side of Gasser, Gasser could have driven off
Gasser could have also just gone straight. It would seem pretty reasonable that if I was worried that someone was going to kill me, I would just run the red light and take off.

I believe a car was in front of him.
And:
quote:
C. A person who is not engaged in unlawful activity and who is in a place where he or she has a right to be shall have no duty to retreat before using deadly force as provided for in this Section, and may stand his or her ground and meet force with force.
D. No finder of fact shall be permitted to consider the possibility of retreat as a factor in determining whether or not the person who used deadly force had a reasonable belief that deadly force was reasonable and apparently necessary to prevent a violent or forcible felony involving life or great bodily harm or to prevent the unlawful entry.

They don't know the intersection
Joe was where a car shouldn't be.
CC
CGJ
That's 3 cars(C) around Gasser(G) and Joe(J) where a car should never be.
He had nowhere to go. Even if he could get out, he is most certainly driving into either head on traffic or t-boning the people getting on Berhman

No problem, just looking at a poster that otherwise is usually pretty reasonable IMO going off the deep end.

The picture on page 15 has the vehicles at the line of the intersection.
And Stand Your Ground still requires a showing of a reasonable fear for your life.

The line you see is the top edge of the paint for the turn lane shown below. Meaning RG was the second car in line and JM pulled up to his right in the turn lane.

they arent. the line to the right of Joe's car is not the intersection line. Joe wasnt even in a lane
Look to the left and ahead for the intersection line.
they werent the first row of cars.
i dont know why Tb08 is getting so much heat in here. its obvious some of you are confused about how that intersection is designed and how the cars were positioned

It only requires a reasonable belief that the only way to stop the intruder from entering your vehicle is to use deadly force.
quote:
(4)(a) When committed by a person lawfully inside a dwelling, a place of business, or a motor vehicle as defined in R.S. 32:1(40) when the conflict began, against a person who is attempting to make an unlawful entry into the dwelling, place of business, or motor vehicle, or who has made an unlawful entry into the dwelling, place of business, or motor vehicle, and the person committing the homicide reasonably believes that the use of deadly force is necessary to prevent the entry or to compel the intruder to leave the dwelling, place of business, or motor vehicle

He's not getting heat for the cars positions. I've been showing the correct layout of cars for pages now
