Hell with a terrorist charge. This is still premeditated lying in wait intentional murder. And he shot the dude in the back with the hopes of ending his life. If that isn’t a death penalty case I don’t know what is. I know NY is not a DP state.

Kinda hard to prove intent based on the actions of others after the killing. Is there any indication that he was hoping to inspire such a thing? If not I don’t know how charges would stick

Communists are hardly explicitly conspiratorial with each other. They are groupthink ants. They just develop their language base and tactics in classrooms and behind masks.
