Bottom line, both individuals in this scenario have done something illegal. If the rapist was put in jail, I would have no problem with that at all, especially since he was with an underage girl and tried to cover it up. As far as the poor guy from south of the border, there is a process to come into this country legally. Follow that and there is no problem.

Then you're going to jail.

However, I think you might have suggested it was a hostess and I unconsciously picked it up. They actually didn't specify her job, just that he was the manager.

Could have been a waitress or a prep girl (they did "do it" on a prep table). The whole thing was caught on security cameras which ultimately brought our boy down.

That doesn’t really address the dichotomy. Don’t rape, and this guy wouldn’t have a problem.

The point is that one guy has a path available to him that doesn’t destroy the life he has built. The other doesn’t. The rapist has some form of leniency under the law. The illegal immigrant doesn’t. I don’t think that’s just. I’m positive the majority of this board will disagree, which baffles me.

I can empathize with the invaders all I want. Hell, I can empathize with 18-year old Kamikaze pilots or 16-year old Wehrmacht conscripts in 1944 and still oppose them.

This guy, in particular, isn't the same guy hiding in the bushes and dragging women behind dumpsters with a knife or a gun. He just isn't. And the circumstances of both incidents, while troubling, suggest the guy may benefit from intervention short of prison.

By the same token, I can understand the drive to get to the U.S. by any means necessary, and still oppose illegal immigration.

It's called "critical thinking", rather than knee jerk emotionalism (which is the purview of extremists on both sides, but particularly the left of late).

No disputing that. He's a POS. Basically, don't commit a crime and you won't have to worry about doing time. I agree about the leniency issue, punishment for crimes needs to be standardized across the board in relation to the crime committed. Unfortunately, that may never happen.

I knew the danger when I responded. I'm not defending the guy.

Rape is a powerful word. A 16-year old isn't a 10-year old. The variability in age of consent laws just in the U.S. are significant. In other words, the first incident isn't even a crime in Alabama.

The second one? According to THE VICTIM - he pressured her to lie down next to him, then they started messing around (consensually) and he wouldn't take no for an answer after the appetizers. This victim was the mother of his children.

Now, does this suggest he's a scumbag? Sure. Does he deserve jail time? Maybe. He's on probation, so the law certainly supports that. But you guys want to shove a broom handle up his arse.

I've never done anything remotely like this. His conduct is appalling - the dishonesty, abuse of position of power, and he doesn't even have the defense of being a stupid kid of 19 or 20 - he's a grown arse man with children of his own.

But, if you cats want to hang old Beau, go ahead. Just make sure your own houses are in order, because the mob turns ugly when it turns.

But you can oppose illegal immigration without supporting a legal system that forces a binary choice.

Just like you can support a legal system that doesn’t force the judge to sentence a two-time rapist to life in prison.

It seems to me like this country is saying a one-size-fits-all approach to illegal immigration is perfectly ok, but for rape, we’ll accommodate some gray area.

apples and oranges hombre! Mr brown skin is here illegally, he has no rights. This guy in question, while not condoning his actions, is a legal citizen and entitled to rights of a citizen.

Look, I agree that raping a 10 year old is slightly more heinous than raping a 16 year old. Even when the 10 year old gives consent. But the fact is, he raped the 16 year old. He broke the law. You can put lipstick on a pig...

No, I don't want to hang old Beau. I just want to be clear that Beau is 33 years old, is the superior of the 16 year old, and raped her by law. As a now grandfather of a baby girl, that wouldn't sit well with me at all. And I would want him prosecuted. Reading this clearly indicates he has some sexual issues, and there's a pattern.

And as far as my own house in order? I give you my word, I'm not raping anyone, and especially not underaged girls. But you don't have to take my word for it. Believe what you want.

And he was. And got probation. And he violated that probation. I get and understand all that. But context remains important and context can/should impact punishment, IMHO.
