The question is whether he was fired for a religious practice/belief and if what he did falls into that bucket and whether animus relating to that led to the termination.
If yes, then probationary period is irrelevant.
Harry argues that they'll just classify it as something else, which is what everyone who fires anyone for an unlawful reason does. But if it's on the heels of the misgendering saga then for good reason the alternative explanation will be seen as mere pretext.
I think the bigger question is whether he can fit the scenario into a protected class situation. Him being a pastor certainly helps in that regard.

I'd imagine plenty if you're doing it on company time. Or do you also think someone could just pray 8 hours a day every day and remain employed?
