well it obviously wasn't suicide or accidental death... what did you think they'd characterize it as? Homicide =/= murder

UPDATE:

quote:

Deputy Chauna Thompson, 45, and her husband, Terry Thompson, 41, also of Crosby, turned themselves in Thursday night. Bail was set at $100,000 each. The couple posted bail Friday morning and they were released. They could face up to life in prison if convicted.
"We grieve with the Hernandez family," District Attorney Kim Ogg said Thursday in announcing the indictment. "We believe that this grand jury true-bill is a reflection of our community's belief that a crime occurred and that crime was murder — and that it was participated in by Terry Thompson and his wife, Deputy Chauna Thompson."

DA is overcharging this and, like many other high profile cases, is going to end up losing. This is clear cut manslaughter and going for murder is going to get them acquitted. People talk about lesser included but juries have pretty consistently shown they either don't like or don't understand that concept. DA needs to charge the actual crime and quit going for headlines.

Isn't third degree murder the same thing as voluntary manslaughter?

A lot of people feel that police are given a slap on the wrist for things that would land civilians in prison. This case will show us just how far above the law cops are (if they are convicted, obviously).

It will be interesting to see if and how their sentences differ.

Murder? It's pretty obvious they didn't intend to kill the guy.

Manslaughter and depraved indifference would be doable here, but murder is going to result in an acquittal.

Agreed. I suspect those charges may drop to exactly that.

Either way, these asshats need a serious timeout.

I'm sure they will differ if convicted. He was charged with murder, she was only charged with accessory to murder.

Yeah....we don't need to be operating a world where its ok for a normal citizen, or really anybody for that matter, can just beat your arse and choke you out for pissing in public.

Haven't paid attention, but they are charging both of them? Did the wife participate, or was she just there. They are making it sound like a cop killing, or at least alluding to it on the radio here, but it sound like the guy just happened to be married to a cop. Have not paid attention or read any actual news on it other than quick updates on radio, so I admit to not knowing the situation.

Uhh, you would have to argue they were brain dead not to realize they were killing him. Had they stopped when several people stated "you are killing him" and begging them to stop they might would have a chance at a lesser charge.

If I get mad at a cop for writing me a ticket and choke him to death for it what should the charge be in your opinion?
