No it isn't but tow trunk drives have never cared about what is or isn't legal

Not sure you could sue if nothing was broken or taken. You could press charges tho and have the tow truck driver arrested or even better 'make a deal' with the tow service company.

I guess technically it would fall under criminal trespass but without any criminal intent I don't see it being charged.

Here's my expert legal opinion:
Tow truck drivers can do whatever the frick they want.
Source: 9 years living in Baton Rouge, watching Riverside break every statute on the books. I've watched them tow legally parked cars, I've seen them store cars illegally (circle k on brightside), I've watched them charge illegal fees, and I've been shaken down by their owner for $3,000 after someone in my vehicle threw a beer bottle at their truck and allegedly broke a windshield.
