He won’t get a lot in a law suit maybe 10k. There are plenty of videos where the police show up because they got a call of suspicious activity. They then explain to the person who called that there is nothing illegal about filming and then they leave and there is no gotcha.

Also, I’m all for not having to say your name. I also agree the cop was wrong.

But not wanting to say your name is odd.

Do you want your worst enemy with a copy of that piece of public information in the future?

Unfortunately, that officer had reasonable suspicion, supported by articulable facts, and you'd have to legally ID yourself in the golden doodle example.

My point is that it’s neither illegal to wear a ski mask or open carry in Louisiana, but if you were to do either under certain circumstances you will be detained and likely arrested. I guess what I described would fall under terrorizing. But my point remains.

Carrying a gun and wearing a mask is different than legally filming a building from a public right of way.

They aren't the same at all.

You're right. I should clarify.

They can ask whatever questions they want. Same as you and me. What's really in question here is, are you compelled to answer under penalty of law? Answer that question is, it depends. It depends which State you're in and in this State it depends whether or not you're being detained or arrested.

In this case not only did the law enforcement officer tell him he wasn't being detained or arrested but if you were to say he were being detained or arrested it would have been an illegal detainment because he had no reasonable suspicion of a crime being committed.

In a lot of these videos the police seem
to know (and often admit) nothing illegal is going on but once their authority is challenged (not identifying) things go south quickly.

I know, you're right I inferred too much from your comments. I clarified. It took me a while to respond because I was reading through 14 pages of this shite.

In my opinion, where the officer went wrong was in detaining him.

One could argue it is exactly the same considering the police massacre that occurred less than a year prior. His purpose, as reasonably perceived by the police, could have been with I’ll intent and warranting interaction.

I (or anyone) can stop and ask for a name for almost any reason. Wouldn't that fall under free speech?

Either way, what do you have going on that you don't want to tell a policeman your name?

Bottom line is, the jackass who was filming this knew what he was doing. He knew he was going to be questioned and for some reason he wanted everyone to see that he knows his rights and that the police was "mistreating" him as if he was some victim or something.

If you don't be an a-hole and know how to handle situations, more times than not things would go smooth.
