Have him repeat it but catch it on cell phone camera. Call the Sheriff and file a restraining order. Then, if he says it again, have him arrested. If he makes an attempt to enter my home, kill him (you can do that in Texas), but make sure to leave a baseball bat by his side.

You absolutely have to file a police report. No need to press charges, but if he ever acts and you blow his brains out, you'll be covered.
