Yeah I agree. Negligent for sure but manslaughter is too much. If they’d passed out from drinking or simply fell asleep would they still be charged with manslaughter? Of course not even though there’s no difference.

It amazes me how many people here seem to be completely unaware of the crime of negligent homicide. This case is a text book case if ever there was one.

Never mind the fact the parents smoked dope. They still passed out and left a 2 year old unsupervised for FOUR HOURS in the middle of the day. This is the definition of negligence. And their negligence resulted in the child’s death. That’s negligent homicide.

How is that beyond people’s ability to grasp? Is it because these parents smoked pot and the acceptable narrative on pot is nothing negative can be associated with it?

I don’t care enough to look at what laws Alabama has on the books, but in Louisiana, Manslaughter is a crime of violence that carries zero to forty. Negligent homicide is a non-aggravated offense that carries zero to five.

Bit of a difference there.

Eta: Defining negligent homicide as a negligence caused death isn’t technically accurate. People get in car accidents every day that result in death. As long as they aren’t drunk, etc, they don’t get arrested for negligent homicide, because negligence isn’t sufficient. It must rise to the level of criminal negligence. Where simple negligence requires simply a deviation from the standard of care, criminal negligence requires a “gross deviation” from the standard of care. Much higher bar to clear.

I wonder if this was determined by confession or a drug screen? Makes a big difference.
