Yeah but in Louisiana you can pay the cop $500 and it goes away. So technically I don't have one.
A DWI is probably one of the hardest things to get pulled nowadays, they've really cracked down.
Also, I've never heard of someone paying the cop directly to take care of something. If you could just pay the cop why would you have gone to jail in the first place? If he's the type to take bribes, why waste the time of going to jail and getting a notch on your arrest record. All arrests will be on your arrest record, regardless of expungement or anything else. Supposedly only the police and gov't are supposed to be able to see an arrest record but nowadays they're popping up on regular background checks; fricking a lot of people over.

I know a guy that applied as a tanker driver at a company that hauls very hazardess chemicals, so past driving record and criminal history is very important to this company. A question on the employment application is " have you ever had a DUI conviction?". He had one 20 years ago that was supposed to be expunged and wiped completely off his record. So he answered no. He was at oriontation for the company and a human resourses person came and pulled him out of class, and asked him if he ever had a DUI. He answered no. The HR person then recited to him the date of the DUI and the locale where it happened. The company immediately dismissed him and told him to leave the property. When he got home he had a criminal background report pulled on himself and it didn't show up, but this company had some source where they were still able to find out about it.
If your friend could prove any of this he would have a pretty solid case. Companies aren't supposed to be able to look at arrest records.

BTW, the HR person told him that if everything else on his record looked good, they would have hired him as long as the DUI was at least 10 years old. They fired him because he lied about it.
By law you do not have to respond "yes" to questions regarding convictions if it has been expunged.

Define "drunk tank."
Just because there's a cell where they put all the drunks doesn't mean you're separate from the other people in jail. If you got arrested, you went to jail.
You may have not even had to bail out. Sometimes they'll just let you sober up and go about your business. Most of the time they'll make you bail out so they can get that revenue.

I think what you meant to say is they have the means to use their brains and not drive drunk.

That looks highly illegal and he should have a good lawsuit to take to court if he can prove it.
But I imagine that the company takes great steps to protect their sources, but then wouldn't he have a good case to get the company to identify their source if the company is not supposed to have access to that information?

Since when are you required to tell the truth about an expunged case?

2 days in EBR; never went back to the dorms & instead had the pleasure of trying to find a spot in one of the holding cells up front. Cramming 31 people into a 15-person cell sure is interesting.
$15,000 in legal fees and the whole ordeal is getting dropped next week. Innocent until proven guilty is kind of a joke; there are some things people can simply say that'll frick you no matter what.

Rape is obviously one of them, as well as assault. What are some other ones?
