You really think they charged him for this specific instance if it were just like 20 other ones?

How is rape defined legally? When I think of rape, it is physically forcing someone down and raping. I am interested in seeing how the court views this. If the accuser wasn't physically forced to give him a bj, and she had an exit that could have been used, I am not sure the DA has a case.

I don't know. As an example, prosecutors often only charge a few potential counts of child pornography, though the offender may have had thousands of files. It allows the prosecutors to focus resources/energy on the easiest to prove or more egregious acts while still getting a good jail sentence upon conviction. Or they only charge certain sex acts for the same reason or because prescription has run on other similar acts.

More of a general question on how rape is defined legally, to a point where someone can be sent to jail. That statement doesnt seem like enough evidence to convict.

Interesting. That makes sense. I guess as a DA rape evidence can be challenging, so you cherry pick the best evidence.

Honestly, I'm not really sure where we are in the conversation or what we're disagreeing on. Are you saying the instance they're charging him with must be different from other alleged instances?

I'm not really concerned whether it's the same as others or totally different. I'd just like the facts to come out and justice be brought to the responsible parties. I was just saying that often, prosecutors choose to pursue acts which are the same or substantially the same as a variety of other acts without charging the other acts. Therefore, yes, it could be that the prosecutors here are charging only this specific act which is not really much different than the others.

I mean, this isn't a rape apology thing. Again, fry the dude as appropriate if true.

You implied this might be a "blow him for the part then regret it later."

There's been a ton of women who came forward with that exact story. They chose to prosecute him for these 2.

I highly doubt they're prosecuting him for a blow job these girls just regret.

Getting my back to the story at hand...
if the only two people in the room were Harvey and the woman and it happened in 2004... how the hell are they going to prove anything they are alleging? I mean she says I didn’t want to, he’ll say she did. How do you convict? I mean are they banking on preconceived notions of Harvey here?

To be sure, I implied this could be one of those scenarios. Not that I think this is necessarily the case, or that it's more likely than not that such is the case here. I'm simply saying that it's possible that this instance isn't any different than many of the others and the prosecutors are pursuing this particular instance for whatever reason, and not every single instance.

Incidentally, I agree with you that, most likely, this is a "legitimate" case to pursue and that it is not a "blow him for the part then regret it later" case. I'm just pointing out that it still could be that scenario. Whichever it turns out to be (prosecutors might be mistaken or not), I hope the perpetrator gets their just desserts.

Ultimately, I think we're on the same page.
