Generally, they do have a duty to mitigate damages and then refund in most cases.

Is that deserving of a refund?
The people payed a non-refundable fee for space. The deal is done. Nothing afterwards matters unless the owner of the space fails to provide.
Does it suck? Yes. Does it matter that it sucks? No.
