Dude went home and then returned? If he went home after the wreck, who's to say he didn't drink at the house? Smart? No...but maybe enough to avoid the charge. How do they prove he was intoxicated while he was in his car????

If he gets leaving the scene and no dui (or in his case 3rd offense)...it's a win for him. That being said, that dude probably doesn't need to be driving anymore....

My buddy’s dad got someone off a dui for a similar deal. Dude wrecked and started drinking the rest of his beer on his tailgate until cops came.

Had a drunk Mexican drive his Astro van right down the tracks, going head to head with me, one time.
Unfortunately I was stopped versus doing 60mph.
Was about 2am and I had all the lights on so it was like driving into the sun, but he kept coming til he got hung up.
