Our 2 outside units have been serviced about 8-10 times since the flood. We have hired an attorney to go back to insurance and make another claim. Waiting on them to decide. The unit was fine until the flood.

This happened to me as well. I argued with the insurance company for weeks but they wouldn't budge. I had to pony up by replacing the inside unit, but they at least paid for the compressor outside (around $1,800).

Here's the deal fellas. If you condenser is broken get a contractor or AC repair guy out and if it's indeed broken then make sure they write it up as damaged by flood and give you a high replacement cost of the unit that way if you need to replace the upstairs portion, you have extra money to go towards that portion. Done and done.
So, just to be clear, have the repairman write up a cost that's high so if you have to replace something that's not covered by the insurance policy there's extra money to replace something that's not covered by the insurance policy?
If that isn't insurance fraud, it's insurance fraud's half brother.
EDIT: Also, why did we need this year old thread bumped?

You need a supplement, not a new claim.

You understand that this is a FEMA policy and your insurance adjuster, who is a contractor for FEMA, has no control over this...

Our bank was going to make us replace because insurance gave us $ to replace it. They were withholding or final check.. If you need more $ because the other things need to be replaced for what ever reason, you should file a supplemental claim asap. They should be out in just a couple of days.

No, never got the adjuster to change his mind. He was a great adjuster that even pointed out stuff I had missed, so I think he really didn't have a choice. Got the condenser serviced and it is still going strong!

Tell him to fill it with "hot shot" if he balks call someone else.
Hotshot is like magic, works with 134a, 410, 22, 12 almost anything.

It is sealed. Water won't lol it. They are designed to be weather proof to an extent. They are only covered on the sides.

A capacitor is less than $10 and a contactor less than $20, I'd change them both anyway.
