On a side note Fireball is the number 1 seller in volume and money for Sazerac. Take that Buffalo Trace.

They are alleging that Fireball (more specifically, Sazerac) is trying to make the “malt beverage” product with lower ABV look just like the full “whisky” product so that customers don’t know they’re different:

They are also alleging that the use of the phrase “natural whisky and other flavors” is intentionally misleading. Apparently the lower ABV product was introduced in 2020 to be sold at places that can’t sell liquor.
I think the whole thing sounds silly but that seems to be the basis of the lawsuit. Sazerac probably did intend for the two products to look identical if we’re being honest. But it’s still a bit ridiculous.

Wow. I’m surprised people couldn’t figure this out considering it’s sold at places that don’t sell liquor.
This is absurd. How is it even possible to sue someone for selling their own product for no reason other than people are too lazy to read or use context clues?!?! Wtf

I started noticing a variety of fake liquor in unlicensed convenience stores maybe 5 years ago. My wife accidentally bought a handle of 30 proof faux vodka one time only. It was pretty foul.
