maybe i am wrong, but I had read that they only asked apple for the signature, which would mean to me that they have written the operating firmware, just can't get it on to the phone.

I don't mind them unlocking the phones so long as they can only use evidence related to the crime they are searching for.
For example, if they go through someone's phone looking for evidence linking them to incident A, they should be able to use it if they find it. BUT if they find evidence leading them to a separate, unrelated incident, they cannot use that evidence to prosecute for that unrelated crime.
If they search my phone looking for evidence of me selling drugs but they find out that I was buying prostitutes, not selling drugs, they cannot prosecute me for the prostitutes.
That's the only way I'm okay with it. Otherwise, that goes far beyond what the 4th amendment intended.
For example, if they go through someone's phone looking for evidence linking them to incident A, they should be able to use it if they find it. BUT if they find evidence leading them to a separate, unrelated incident, they cannot use that evidence to prosecute for that unrelated crime.

Can't you see this is the way to extreme manipulation? Say there is someone running for office that is outside the establishment and holds the same core values that you do, envisions the same America that you do. He has nudes of a woman that isn't his wife on his phone and they get leaked. Or he has explicit texts to his wife that get leaked that outline his extreme fetishes with her. Or he visited a website with a racist joke on it. Or any number of things that really have nothing to do with him as a candidate that could destroy his campaign. The FBI tried it with MLK Jr. Don't think the govt wouldn't do it again.

I don't believe that's how current search warrants work. If police bust in your house looking for drugs but find your army of midget slaves instead, they aren't going to disregard that.
Eta- in addition to what ^^^^^ he said parallel construction is where they do their own investigation outside of warrants and judicial supervision, then plant undercover agents on "anonymous tips" to frame the "bad guys". These include wiretapping, geolocating using your phone, accessing your emails, messaging, internet usage, history, bank accounts etc.
It's a blatant violation of the 4th amendment. If you have time Google " stingray" and "parallel construction" sometime, or even "asset forfeiture" if you feel really brave.

This is all grandstanding. I seriously doubt the FBI couldn't hack an encrypted phone with the amount of cyber hackers they employ.
