You're confusing operational regulations ( sanitary, electrical, plumbing etc..) with regulating the patrons of an establishment doing something that is legal. That is an owners right to choose rather to allow it or not.

The smoking issue is a tough one. You'd like to see freedom for bar/restaurant owners to do as they please regarding a legal substance.
And while it's indisputable what smoking does to others via secondhand smoke, nobody forces you to choose to eat/drink at a place that has smoking.

TLDR I don't give a frick either way.

If smoking makes the air, food and drink unsanitary (which it does), then there's obviously some crossover, yes?

You've identified two things that are asymmetrical information problems and one thing which is open and obvious and can be determined ahead of time.

So your argument is the regulations are all consuming anyways, so one more doesn't matter?

My argument would be to use the momentum of defeating this to go after some of the other non-essential regulations controlling choices that would be solved by the free market. This isn't a zero sum game, and I'm not for totally unregulated businesses.

No, I'm saying that solving an asymmetrical information problem is different than whether one should intervene on an open and obvious situation.

By the way, you're trying to use a reduction to absurdity argument, but it actually fails. If the restaurants are making it clear they are serving expired food, the problem will take care of itself. MARKETS! Just like if patrons stopped patronizing places that allowed smoking, they would stop. MARKETS! They really are amazing little things. Revolutionary, really.

Um, yes? First of all, it's hilarious to me that you're saying regulations can protect us all, but then quoting "expiration dates" as the end all be all, which according to the USDA aren't even heavily regulated.

I don't smoke I do firmly believe in a private businesses right to choose on this issue. It's not like it's a ninja attack, you know if a place allows smoking before you ever go in. Everybody has a choice.
