Roughly 15k-20k more than the other spouse, will they have to pay alimony?

But it depends on the grounds for divorce, the state, and who has the better attorney.

if you know a divorce is unavoidable, my advice is to get the best attorney you can afford.

then back out completely and let you attorney handle everything. have as little communication as possible. do not lose your temper ever. do not belittle her in the company of mutual friends.

First it depends on whether the party seeking alimony is free from fault in the dissolution of the marriage. That can be a very tricky and drawn out process wherein the parties typically spend a fortune on making the other person’s life as miserable as possible. Often with no net positive return.

If the claiming party is free from fault to a pretty irrefutable degree, then the next step is the oftentimes drawn out and yet again expensive determination of the following formula: factor together the “status quo of the parties during the matrimonial regime i.e. their standard of living, and the paying party’s ability to pay.”

That’s it in a nutshell. Give or take a few other critical or non critical aspects. Lol

In some states, you can do a buyout. It may cost you your 401(k), but you won't have to make payments until you die.

And some states don't care if there is "fault".

You may have a point in language only, but I don’t think there are many jurisdictions throughout the entire country in which a alimony claimant “takes the person “to the cleaners” if the defendant has “bed spring evidence” of an affair, or say defending party is judicially documented victim of spousal abuse, or does a claimant have a decent claim from prison? While serving a life sentence for murder?? I don’t think “no fault state” puts them in the money. How about you??
