They both should be if it happened here. There are so many safeguards in place to keep this kind of mixup from happening in the US, and I'd imagine it's similar in S. Korea.

I think it's both but that negligence is a bit light. At least Manslaughter (or the SK equivalent).

As far as I know, abortion is the only medical procedure where the intent is specifically to take take a life. I personally think it should be outlawed, but if you are going to perform this procedure, you better make sure you have the right person. Its different if you are trying to save a life and make a mistake that accidentally kills someone.
