Check out LA RS 22:1284 if you are in Louisiana. Your insurance may not be telling you the truth.

You should get an attorney and stop talking, period.

So they are giving you max on the property damage and are covering the cost of you admittedly minor injuries?

No lawyer can get you more for your car. It doesn’t exist.

Do you want to do a fake work up from an on-the-take doctor to come up with some additional health problems?

Do you have UM coverage? You can probably make a claim against that for the balance of your car.

That’s not how uninsured property damage works. The at fault party has insurance so uninsured property damage doesn’t pay because the other party had insurance. He would have to claim under his collision. His collision wouldn’t pay because he would have had to sign a release to get the $25k from the bat fault carrier.

I would at least talk to an attorney. You don’t have to be severely injured or permanently disabled to get a decent settlement.

Sorry, but you misunderstand what I wrote, or the point that I was trying to make. The general point that I was making is that when you are insured, and file a claim, the claimant's recovery is always dependent on the limits of your own policy, not the offending party. Absent any legal action, this will always be the case, and this is true for auto and homeowners insurance.

Not if he signs a release.

Edit: and you all are making it harder than it needs to be. The at-fault carrier has accepted liability and told him there is a limits issue. He should just file through his carrier l, pay his deductible, and get his vehicle replaced.

He will get his deductible back through subrogation. He can even talk to his carrier and have them contact the at fault carrier and see if they will just forward him his deductible. Then he doesn’t have to wait for the sale of salvage. The other two carriers can handle it from there between both of them.
