It’s a 50+ foot tree with a bunch of branches (some are really large and heavy) directly over my roof. This isn’t a mom pop job sadly.

its a healthy tree. it ain't improperly maintained. the fact that you bought a house in the way of a growing tree does not materially mean improperly maintained.

Tell her you are cutting it regardless bc it poses a threat to your housing structure. She can either work with you allowing you(or if you hire someone) on her property, you r they will cut from your yard. You then cannot be responsible for any debris, etc. in her yard since she did not give you permission.

I’m hoping you’re not expecting her to pay for it- however. This would be your responsibility, bc if it did fall and damaged your property, it’s your responsibility, not hers.

Probably pretty easy if you act like adult.

I have spent a lot of my own money having tree cut down on 2 of my neighbors property. The trees had a heavy lean towards my home and they said that they didn't have the money to have them cut. But they said that if I wanted to have them removed they were fine with it aqs long as i paid. You are probably in a better finacial situation than the old lady. Hire someone to take care of it.

Can you not just do the right thing and just get somebody to cut the limbs over your roof?

If it was such a problem why didn’t you ask her years ago? A 100 year old tree doesn’t just sprout limbs as big as your talking about in months.

Pictures would be nice.

Get a quote from a tree service and see what you're looking at.

She may help you with cost, but can't handle the stress of dealing with the project.

You can ask your neighbor that you're worried THEIR tree may cause an issue if some inclement weather were to knock it down and onto your property. If they say no, you can do it yourself up to where your property line meets by either A) doing it yourself or B) paying someone to do it. Those are your options.

An unhealthy/dying tree will show signs within the branches and tree itself that would lead to why maybe a limb fell, but just because it's healthy and it fell doesn't mean anything other than you got unlucky and should've taken care of it in advance.

hmmm... seems like you are proving your own knowledge of said negligence in maintaining and protecting your own home and property. This is proof for your HO3 carrier to deny your claim.

Tell her tough shite.

You don’t want to have to replace a roof.

I would call my insurance, get whatever “act of god” clause, explanation, etc. provide it to her, and see if she will be reasonable.

If not- do what you got to do. After it’s done, ask her if she would allow you to go on her property to clean up. If not- it’s on her.
