It is except for the proper exercise of defense of self or defense of others. If/when it is shown they did not have the right to self-defense etc then it is murder in TX because there is clear intent to kill or commit great bodily harm.

Interesting the Texas Ranger stated it was a grave mistake but felt no actual crime was committed. The Judge would not allow the jury to hear it.
I'm thinking this will be the primary reason the defense files for retrial.

And rightly so. That's no different in a regular trial if you could put someone on the stand and say "I don't think he did it." The trooper had no idea what was in her mind. That would have created a dog and pony show where you bring up witnesses on each side "I think she did it", "I think it was a mistake."
There has to be some element of strict liability for misuse of firearms. There was no need for her to go in guns a blazing even if it had been her apartment (she knew someone was in there before she opened the door; she could have waited and called for help); if she chooses to do that and effs up, she pays the consequences.

Possibly the judge felt his word would be taken as an "expert " witness, IDK.
She is a foolish, uncaring person, so self-absorbed she didnt even try to render aid.

I know you're joking, as I was earlier, but it pissed me off that the cops made sure that got out.
It was simple character assassination after the fact.
He was a good guy, by all accounts, and it absolutely had nothing to do with his death.
