Pretty sure there have been cases already about this exact scenario and the courts ruled in favor of the drone flyer. I guess the only thing you could hope for is to have solid evidence of breech of privacy, otherwise you are probably gonna "do the time".

Cops have used planes to issue speeding tickets in the past.
In Missouri, the only time I ever heard of it is when university is done for the semester the cops will use planes to nab the speeders leaving the city (in this case Columbia)

So this is actually a 'when pigs fly' scenario?

Sure the law says "20 years in federal prison", but many have done this and I don't know of anyone who has come close to doing time. It is all part of the scare tactics by some people calling them "Aircraft".
Bottom line is I support UAVs. It is some of the idiots at the controls who are going to cause problems. So the technology has gotten ahead of the law. Let's take discharging a firearm out of the question, even though it is legal on my property. What if a drone over someone's house was taken down another way? Say, A water hose? Would that get 20 years in the pokie?

It isn't worth getting charged with a felony and facing up to 20 years in a federal prison somewhere. Doesn't seem like that tough of a decision too me
Not cut and dried, many have been shot down and the FAA has not gotten involved.
I would not just blast away but there is legal precedent.

Now a Kentucky court has declared Merideth an innocent man. Bullitt County District Court Judge Rebecca Ward on Monday dismissed all charges against Merideth, reported local TV station WDRB-TV.
The drone's owner, David Boggs, had produced flight data that insisted his machine had been flying higher than Merideth had claimed.
The judge, however, seems not a fan of big data. She's a woman of the people. She declared that two human witnesses saw the drone below the tree line. This evidence was, to her, conclusive. To her, this was an invasion of Merideth's privacy.

I've got no problem with the police enforcing speed limits as long as it is not a speed trap where the driver has to reduce speed dramatically in a short distance. Most folks that speed are just rushing to get to the next congested traffic area where they have to slow down again . . . what's the point?

WTF folks? Do we now get to look forward to a new form of enforcement terror from above?

because a mile or so down the road was a cop, on the side of the road with lights on, holding what sure looked like to my driver buddy to be a remote control for said drone.
You could turn that cop into the FAA, because he would be breaking Federal law. Drone flights that have the drone going beyond visible range are illegal.
Wonder if he even has his Part 107 since he isn't using the drone for hobbyist purposes.
ETA: Ah, cable inspections, those guys know what they are doing.

Waivers? The FAA does all the time.
quote:well they have to get between the interstate and if they take off from the median some of those areas sure are thin to be flying a projectile between interstate traffic.
If they are flying that drone over the middle of the median, then they don't need a waiver.
quote:if they can without you can without. you as a rec pilot have more freedom than they do.
Cool, so I too can fly a "drone" over a median without a waiver?
quote:i dont know very what?
Apparently you don't know very far
quote:maybe for destruction of property but it is illegal to fly over a person without their consent. which is why i hate it when i see a dude flying a drone over a parade or something like that.

They used to run Cessna single wings down Hwy 90 to catch speeders. It was really expensive so they only did it during peak travel times usually. I saw them flying in at least 5 occasions. It only makes sense to switch to drone technology.
Just look for the white lines painted perpendicular across the highway and slow down between line number 1 and 2.

When does drone season officially open in Louisiana?
