Don't sign anything until you do the thorough credit check and hidden asset due diligence. I found a hidden bank acct and 401K loan through her employer thankfully. When the ploy was to "I'll just give you half my debt if you push" I offered up a stern "ok!".

Oh you sneaky frick. How the frick did you find that? Secured debt like that through an employer doesn't show up on a credit report.
Furthermore, what good does finding a 401k loan do for you, unless 1. she accrued this 401k while married to you and 2. she quit that job and kept the money akin to taking a penalized withdrawal.

Is she trying to get closer to 50% on her share of expenses, or is she actually trying to get assets of HIS that she feels ENTITLED to? Big difference you motorboatin bitches. I fricking hate family law.
truth be told, probably the latter, but... im not working on the legal team in her case, so i am not sure. she said its just to get closer to 50%, but shes all emotion right now.

she reached out to me because i have extensive experience (but not in family). the p.i. firm that we used for this type of stuff is who her family attorney wants to use.

its one of her ex's frat brothers, so you can understand why she wants someone else. another paralegal friend told me sly fox investigations does financial asset searches. Ive never heard of them though so i was going to pass that name along too.

and there's also this thing called a subpoena

While true, there's also a thing called a lie, especially in the situation of bitter divorces. Thus, the need for forensic accountants. Obviously, a deposition would be the started point.

Wonder if a judge can make a party to a divorce obtain and divulge an IRS transcript? That'd uncover a few assets right there, assuming you knew the entity name/tax id number that held them.

honestly, i think the money shuffled was retirement... so that is exactly why she wants a financial asset search instead of a forensic accountant.

Don't you egg this behavior on. This isn't a fair is fair thing but her trying to get after something of value that's clearly not hers but she potentially will have a lawful(not ETHICAL) right to if she can verify ownership and quantify value. GOD DAMMIT! I hate this shite. I'm out.

Not really mad.

Mike, that'd be pretty easy to find huh? Paystub/W-2 discloses 401k, 401k statement balance discloses value and loan, no?

Yea True. No doubt it's easy to acquire during discovery. Still want to know the value in it.

of course there will be lying, that's what a deposition is for, to identify the liars, pre-trial, it's not as easy to hide assets as everyone(usually the woman, because that's what she learns from the Lifetime channel,)thinks, in the majority of cases, PI's, forensic accountants, depos, and actuarians, are a tremendous waste of money
