What sucks is yes he may win a civil suit against the city for wrongful termination. But on the horizon is the civil suit against him from the Sterling family. I think it's garbage and he did nothing wrong to warrant being sued in civil court but the obligations to meet are less and unfortunately he has a bad chance on losing that battle. It sounds like he may rob Peter to pay Paul in this instance which is insanity.

I’m not a lawyer, but how can Sterling’s family win if Sterling tried to fight the cops and pull a gun while on every drug imaginable? There’s no wrongful death there.

So the two highest ups cleared him of any wrong doing but the city is going to fire him.
There's a big difference between not doing something illegal and not properly following police department policy.

One gets you arrested. The other gets you fired.

This civi case is absolutely going to result in a settlement. Probably sooner than later. Just reality.

SWB and the retards on the Metro Council will sell out BRPD and throw money at the Sterling family, just like they did with the protestors.

They'll base it off of the findings that Salimoni violated department policy and the inevitable firing. And it's not like the City of Baton Rouge will fight the suit hard

Isn't Louisiana and AT WILL employment state? meaning they legally don't need a reason to fire him? Or does civil service supersede that?

Good point. Broome probably already has a big check written up in her office and is planning the catered settlement meeting as we speak.

Yea, killing an armed black felon in BR gets you fired.

I wish there was a better answer than "just because" the justice system is frickED and just how it's going to be. Us rational people think no harm no foul he shouldn't be held liable. But the justice system doesn't think the same.

How is this even controversial? He should never have any job where he carries a weapon again.

Much lower standard of proof and the availability of comparative fault

Why, specifically?

Why wait until he’s cleared of criminal wrongdoing?

Unless Landry was advising them on personnel matters along the way, they’re basically admitted they’re firing him now because he wasn’t indicted. Seems strange, but maybe I’m missing something.

No, obviously it doesn't or there would have been many more police firings over the last 10 years.

As Salamoni's attorney described the situation today, he believes the stated reason his client will be fired is because the officer violated police department policy by putting his gun to Sterling's head and telling Sterling he was going to "f*cking kill" him as soon as Sterling refused to put his hands on the car when the officers first approached him.

That escalated the situation rather than following police policy of de-escalating a confrontation.

Look, if it were up to me I'd give both Salamoni and Lake a bonus and a medal for ridding our city of that piece of filth Sterling, but it's not up to me. And if it's true Salamoni did not follow the policy he was trained to follow, he probably will lose his job.

Except the whole part where he didn't do anything wrong
