Just saw he was wanted for the three other armed robberies. That'll certainly enhance his sentence. The tools are there, I just hope they're used. I'm a little jaded by the justice system after years of arresting shitheads and seeing criminals facing 50-60 years in prison get 10 year sentences.

One goes to prison, 2+ more will take his place. There is no stopping the continuing landside. Rational thinking would make you believe that ALL of society would be outraged and sick of this type of shite and demand change. Instead, 24 hr MSM makes excuses and almost seems to encourage the decline

Yes really. There is a family in Tennessee suffering because of this fricker. The only thing the perpetrator's family will suffer is wearing the airbrushed shirts that say "free whateverthefrickhisnameis"

3 armed robberies and a murder in less than a month. Think about that. You know that piece of shite was bragging about how he 'kilt' that white dude like it was something to be proud of. Could you imagine if he did that to someone in your family? Someone you loved? Your wife? Your child? These pieces of absolute shite have no care in the world about human life. None. They're animals. They're worse than animals. They're like rabid animals. There is no good in them whatsoever. They need to be put down like a rabid raccoon would be.

1st degree murder in Louisiana has nothing to do with premeditation. It is determined by a list of aggravating factors.

In the case of murdering someone during the commission of an armed robbery, the determining factor between 1st and 2nd degree murder is specific intent.

1st degree murder - engaged in armed robbery AND specific intent to kill

2nd degree murder - engaged in armed robbery but lacked specific intent to kill

If his attorney can present a cogent argument that the defendant had no intent to kill the victim when he shot him in the chest - such as evidence of the gun discharging accidentally - then perhaps 1st degree murder is off the table entirely. But if you purposely shoot a person, you have specific intent to kill.

But whatever..maybe his attorney will argue that he's mentally retarded and didn't fully understand that shooting a person will likely cause them to die, thus declaring that he lacked specific intent on those grounds. That still makes it a 2nd degree which brings me to the second part of your post - the "he'll get 20 or so years and be out in 16" part.

Patently false.

LRS 14:30.1 (2nd degree murder)
Whoever commits the crime of second degree murder shall be punished by life imprisonment at hard labor without benefit of parole, probation, or suspension of sentence

Additionally, LRS 14:64 (armed robbery)
Whoever commits the crime of armed robbery shall be imprisoned at hard labor for not less than ten years and for not more than ninety-nine years, without benefit of parole, probation, or suspension of sentence.

His best chance would be to plea to 2nd degree and accept life in exchange for the DA dropping the robbery charges which add a minimum of 30 years to his sentence. But I doubt he even gets an offer that generous.

What posters on here are saying is that he may get charged with murder initially but will probably get sentenced to a lesser charge or take a plea deal.
