0.087 is probably within margin of error for breathalyzer.

Breathalyzers assume blood/breath coefficient of 2000 or so. As in concentration 2000x higher in blood than breath. That ratio is merely an average, not same in all people. An individual's coefficient is different from day to day and hour to hour.

fricking up someone's life based on a breathalyzer barely above legal limit is wrong.

Guy shouldn't have driven.
But, he didn't cause accident.

Sad all around.

Yep, and it’s ridiculous.

So if it was an elderly driver with poor reflexes, could they be charged with vehicular homicide because they couldn’t avoid the accident?

At least half of my frat bros are lawyers and or judges, over the years, without exception, they all say, don’t blow, don’t take a field test, don’t give them any help, fortunately I’ve never had to follow their advice

I can’t see him getting any actual jail time.

Will have to do stuff for the BAC level but other than like a DWI, i doubt he gets anything major

Does a breathalyzer provide 100% accurate results 100% of the time? Is every American over 21 years of age affected by the volume of alcohol to reach the "impaired" measurement of 0.08 BAC identically?

This guy's life is about to get really fricked up because a 22 y/o not wearing a seatbelt killed herself.

It's bullshite.

there was a study done by the Navy years ago about the affect of alcohol and flying with fighter pilots as the test group, the study showed the pilots were at peak performance after about a six pack of beer

Lmao hoodrats shoot at each other and don’t get attempted murder charges. This guy is in the wrong place at wrong time and gets booked with vehicular homicide. Our justice system is a joke.
