But you're right, this really wouldn't set any precedents. In fact, the article states the precedent was set back in 1912...the convicted was set free.

The best way to handle this is for the governor to pardon the defendant. Going to court and getting any sort of judgment, etc. could lead to a precedent being set. Any precedent with a bright line rule could be used to the detriment of the accused, not to their benefit.

im amazed that there isnt any standard on the books already regarding a timeframe between verdict and initiating the penalty....
"we sentence you to one year at a time of our choosing" could be a pretty ominous thing to have looming over you.

There is no end to the stupidity government is capable of. A judge or governor with balls and common sense would release him.
