Anyone watch the Fox News report on the truth about sex and college?

It's interesting to me that colleges are almost always forced to punish the accused or the government might come after them

Do you mean punished the accused?

And yes - men are getting a rough deal. Guilt is almost presumed these days. Making matters worse, there's little in the way of due process.

yes and the guy profiled his jury consisted of 9 women and he wasn't even allowed to bring a lawyer with him

If I were ever falsely accused of rape and convicted, I'd serve my time and promptly murder the accuser and her entire family on the day I was released. Your life is already over anyhow. Her family gets the business bc it's about an example. I'd even kill the dog.

Me too. Unless it was life in prison. Could you imagine? Guys get convicted with zero physical evidence. Like this one, where the accuser actually recanted everything but the guy will still die in Angola.

I understand wanting colleges to take sexual assault more seriously, but you also want to have a fair trial for both sides

The John Kinsel case is one of the most disgusting and disturbing abuses of a prosecutor's power I have ever seen in my legal career. They essentially took the position the "victim" was a liar but she was lying now for some unknown reason. Courts hands were tied because of stupid procedural rules. Word is they even threatened the "victim" with perjury charges and she still maintained she lied and was willing to accept the consequences.

it's appallingly cruel. The accuser was willing to take a perjury charge. And Bc it's LWOP and the Feds can't muster enough jurisdiction, his only hope is a governor pardon. Which means he has no hope. Its bad enough that one girls testimony can send a man to Angola without any corroborating evidence, but to have all higher courts and the DAs simply not give a shite when she recants is disgusting. And it's disappointing that this is the one damn case where the Feds decide they lack power. The one time.

Wow this Kinsel case BS is insane. The guy is clearly innocent. State govt is trying to keep him in prison so he can't get out and sue them for all they're worth

Prior to the victim recanting, Kinsel used up his post conviction rights including habeas. It's disgusting but you only get one shot at habeas. They basically said he already took his shot and their hands were tied.

I thought if new evidence came to light, he would have grounds for a new appeal. I'm not sure if the time limits though and I haven't done appellate work. Pretty sure the DA could spring this innocent man from Angola but that would involve the DA doing the right thing and facing a lawsuit.

The DAs office actually fought tooth and nail to keep him in prison. He actually won a new trial and the DAs office appealed it in an effort to have it reversed (and it was)

I know the attorney handling the case and last I heard she was considering trying original habeas jurisdiction directly to SCOTUS. SCOTUS declined to hear the original dismissal of his most recent habeas application.

Here is the rule when it comes to this--don't stick your wicket into any female with Crazy Eyes. If you follow this basic tenet then you will never have a problem being falsely accused.

I've met Autumn too and I offered her my help with this case years ago, but she knows what she's doing. I think about this case often even though I've never been involved with it. Just stuck with me.

the guy profiled the school claimed that his "smoking gun" in this situation is that the girl asked him for gum to freshen her breath and that should have been obvious that she was drunk like those two go exclusively together
