There is going to be a boatload of leeway when it comes to the prosecution.

I highly doubt this. There are certainly other security cameras and no less than a dozen mandeville housewife who saw it. At least 2 or 3 of the were sober enough to clearly articulate what happened and testify.

I'm former Army, worked for over 10 years with the Navy and Marines. There are despicable people in every branch, at every rank.
Add to that you don't have to do anything special to be promoted to O-3, it's a simple time-in-grade promotion. most officers get there by just not punching old men out.
