Well, that's not the case here as far as I know, so why wouldn't you want to make sure you don't get screwed? If you give an insurance company an inch, they'll take more than a mile.

Take out the phone and record both the damage, surrounding area to document the crash. Also get his confession on video to being drunk and causing the accident.

Tell his mom that in addition to repairing your vehicle she is going to pay you another $1000 to keep this off the books. After that we are all good. Also if she is hot, we can skip the extra money for some of that arse. If the kid is a hot college girl, we can skip everything for a night of banging. I'll call later and say hit and run.

I would have called to cops to ensure I get a police report showing they were at fault. He made a very stupid decision and does not deserve me taking the risk of him or his parents not paying.

Has some value, but it's not perfect. If you can grab some photos prior to moving the vehicles off to the side. That has helped me in the past more than the police report.

No I hear ya.


I would have called the cops as well. The kid driving drunk and getting in trouble for it isn't my problem tbh. That was his decision. My problem is getting my car fixed.


And thousands of dollars in damage is not a little bump...he must have hit the car pretty hard.

What happens if what he thinks is minor, really damaged some internal parts? Or the repair guy tells the parent some of the damage was pre-existing? Dumb move on her part. After their son pulls off, they can turn stupid, and no one can prove them wrong.

Not only that, but you are perpetuating a problem. I see people on this site complain about insurance premiums all the time. If the insurance company knew he was driving under the influence, they would pay the claim and then cancel the customer to avoid the risk.

I got hit in Galveston by a young girl that I knew had been drinking. The entire island has about 7 cops and the 4th of July parade which all 7 cops and the entire island attends was about to start. Not a chance in hell I was getting a cop out there for at LEAST 4-5 hours.

So we exchanged info and her insurance company confirmed the story with both of us (and she told the truth -- that she ran a stop sign), and they paid for all of my repairs.

I wouldn't normally do that, but I knew for sure there were no cops available to help us.

Actually, the only other accident a vehicle of mine as been involved in was when some people ran into the back while we were at a red light... pushing me into the car in front of me. We had the police come out and wrote up a report. I confirmed they hit us from behind, the car in front of me confirmed the same...

But when the person at fault's insurance company called, they said the person was claiming we cut in front of them.. and apparently that is what they put in their police report too.

So a police report didn't necessarily protect anything.

I'd wait a couple hours then call the cops

drunk driver can get DWI because he drank "after" the accident and I get my police report to make sure damages will be handled

Ok separate from this incident which involved a drunk person

All the police do is get statements and record the statements in the report. They also draw a sketch of what they are told. It's ultimately up to the insurance to determine fault.

Your friend is doing the right thing.


But a cautionary tale, Mrs P got screwed pretty hard in a similar situation about a year ago. She knew the kid's dad and told him they could deal with it off the books. Then when she got in touch with the father he basically said he wasn't bailing his piece of shite kid or anymore and we got hit with a pretty harsh deductible and the ding on insurance.

unless a moving traffic violation is issued. i.e. Following too closely, speeding, failure to stop at a traffic control device etc...
