Fun piece of trivia. I had the first Coca Cola Classic ever. Well, not the first one ever, but first sold to the public. Our local bottling plant was the first to roll them out. It was on the news that it was going to be happening. Had a buddy working at the grocery store down the road and they were always the first store on the Coke delivery guys' route as it wasn't that far away and no stores in between. We got tipped off that they were coming and as soon as the driver put them out, I purchased a 6 pack.

It the same with canes sauce.

You cannot patent a recipe, but you can copyright it, but copyright would mean that it would need to be published therefore your trade secrets are public. Where it gets shady in copyright is that a list may not be copyrighted but the actual verbal descriptions of how to make it are.
